This Policy applies to Elseway, the website available at elseway.ai, the Elseway mobile application, and related services that link to this Policy (collectively, the "Services").

By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not access or use the Services.

Information We Collect

Information you provide directly to us

We may collect information you provide when you use the Services, register for an account, contact us, submit a report, or participate in a feature or promotion. This may include:

• email address, username, display name, avatar, and account settings;
• payment information, for example through payment processing vendors;
• User Content, including stories, characters, personas, prompts, chats, images, video, audio, comments, reports, and feedback;
• contents of communications with us.

Information we collect automatically

We and our service providers may collect information about the devices and browsers you use to access the Services, including IP address, device identifiers, advertising identifiers where permitted, app version, operating system, browser type, device model, access times, pages or screens viewed, features used, usage activity, diagnostics, crash data, app launches, sessions, install source, campaign or referrer information, and approximate location inferred from IP address.

Information from other sources

We may receive information from authentication providers, payment processors, analytics providers, safety vendors, cloud infrastructure providers, AI service providers, advertising platforms, attribution providers, and other service providers that help us operate, secure, measure, and improve the Services.

How We Use Information

We may use your information to:

• provide, administer, maintain, and improve the Services;
• create and manage accounts, authenticate users, and secure the Services;
• generate AI responses, run story chat features, and personalize your experience;
• process payments, refunds, chargebacks, and support requests;
• communicate with you about your account, the Services, policies, and support;
• analyze usage, fix errors, develop new features, and improve AI features, quality, safety, and performance, where permitted;
• understand how users discover Elseway and improve Elseway and our marketing;
• measure the performance of advertising campaigns and understand the effectiveness of our marketing;
• attribute installs and in-app events to marketing channels;
• detect, prevent, and respond to fraud, abuse, security incidents, technical issues, and misuse of the Services;
• comply with legal obligations and enforce our Terms of Use;
• carry out any other purpose for which the information was collected.

We may aggregate or de-identify information and use or disclose it for any lawful purpose, including research, analytics, improvement, and marketing.

When We Disclose Information

We may disclose information in the following circumstances:

• Affiliates. We may disclose information to current or future affiliates in a manner consistent with this Policy.
• Vendors. We may disclose information to vendors and service providers that support hosting, storage, authentication, analytics, payments, customer service, safety review, content moderation, AI processing, and other operations.
• Payment providers. We may exchange transaction information with payment providers to process payments, verify transactions, prevent fraud, and provide support.
• Advertising, analytics, and attribution partners. We may disclose or make available certain identifiers, device information, approximate location, app activity, install or referrer information, and purchase or subscription events to advertising, analytics, and attribution partners, including Meta Platforms, Inc. and AppsFlyer Ltd. We use these partners to understand how users discover Elseway, measure ad performance, attribute installs and events, prevent fraud, analyze usage, and improve our marketing. These partners may process information as our service providers and/or under their own privacy policies depending on the service, configuration, and applicable law.
• Safety and legal reasons. We may disclose information when we believe it is necessary to comply with law, respond to legal process, enforce our Terms, investigate abuse, protect safety, or prevent fraud or security issues.
• Business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
• Your User Content. Content you publish, share, or make available to others through the Services may be visible to other users or the public.
• With consent or at your direction. We may disclose information when you direct us to do so or otherwise consent.

Cookies, SDKs, Analytics, Advertising, and Attribution

We and our service providers may use cookies, SDKs, local storage, device identifiers, pixels, and similar technologies to operate the Services, remember preferences, keep you logged in, analyze usage, measure performance, prevent fraud and abuse, understand how users discover Elseway, measure advertising performance, attribute installs and in-app events to marketing campaigns, and improve Elseway and our marketing.

We use analytics, advertising, and attribution services, including Meta SDK / Meta App Events and AppsFlyer, to understand how users discover Elseway, measure the performance of our marketing campaigns, attribute installs and in-app events, prevent fraud, analyze usage, and improve our Services.

When you use our mobile applications, we and our analytics, advertising, and attribution partners may collect or receive technical information and limited app activity information, such as device identifiers, advertising identifiers where permitted, IP address, approximate location inferred from IP address, device model, operating system, app version, install source, campaign or referrer information, app launches, sessions, and limited in-app events such as account creation, subscription or purchase events, feature usage, and other app interactions.

These identifiers may include Apple IDFA where permitted, Apple IDFV, Google Advertising ID / Android Advertising ID, AppsFlyer ID, Meta App Events identifiers, and similar device, analytics, or attribution identifiers.

We do not intentionally send the contents of your private chats, prompts, stories, personas, character descriptions, generated images, or other user-generated creative content to Meta or AppsFlyer for advertising or attribution purposes.

You may be able to control some cookies or advertising identifiers through your browser or device settings.

Mobile Advertising and Privacy Choices

On iOS, where required, we request your permission through Apple's AppTrackingTransparency framework before allowing tracking as defined by Apple. You can change your choice at any time in your device settings under Privacy & Security > Tracking. If you ask the app not to track, we will not use Apple's IDFA or engage in tracking as defined by Apple for that device, although we may still use information for app functionality, security, fraud prevention, analytics, and permitted attribution methods.

On Android, Apple's AppTrackingTransparency framework does not apply. You can reset or delete your Advertising ID or limit ads personalization through your Android device settings. We honor device-level advertising identifier choices where required. Google Play requires developers to disclose Advertising ID and related data collection or use where applicable.

Your Choices

You may update certain account information in the App. You may unsubscribe from marketing emails by following the directions in those emails, though we may still send administrative or service-related messages.

Depending on your location, you may have rights to access, correct, delete, export, restrict, or object to certain processing of your personal information. To make a privacy request, contact us at [email protected]. We may need to verify your identity before responding.

Regional Privacy Rights

Some jurisdictions provide additional privacy rights. For example, residents of the European Economic Area, United Kingdom, California, Nevada, and certain U.S. states may have rights regarding access, deletion, correction, portability, objection, opt-out, or appeal, subject to legal limits. We do not sell personal information for money. We may disclose or make available certain identifiers, device information, and app activity to advertising and attribution partners to promote Elseway, measure ad performance, and improve our marketing. Depending on where you live, this may be considered "sharing," "targeted advertising," or a "sale" under applicable privacy laws, even if no money is exchanged for the information.

Children's Privacy

The Services are not designed for anyone under 18, and our Terms of Use prohibit use by anyone under 18. If we learn that a person under 18 has provided personal information to us, we will take appropriate steps to close the account and delete the information to the extent required by law.

Security

We use reasonable technical, administrative, and organizational safeguards designed to protect information. However, no Internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

Data Retention

We keep information for the time necessary for the purposes for which it is processed, including to provide the Services, comply with legal obligations, resolve disputes, prevent abuse, and enforce our agreements. We may delete or aggregate information after it is no longer needed.

If a public character you create reaches a level of popularity where deletion would affect other users' experience, we may preserve that public character or keep it available while removing or limiting personal information associated with the creator where required.

Account Deletion

Account deletion is permanent and different from logging out. Once your account is deleted, it cannot be recovered, and you may permanently lose access to products, services, characters, favorites, memories, chat logs, interaction data, and other assets associated with the account.

When your account is deleted, we will delete, de-identify, or restrict access to personal information associated with your account as required by applicable law. Some information may remain where necessary for legal, safety, security, fraud prevention, payment, tax, accounting, dispute resolution, backup, enforcement, or legitimate business purposes.

International Transfers

We are based in the United States and may process information in the United States and other countries. Those countries may have privacy laws that differ from the laws where you live.

Links to Third-Party Websites

The Services may contain links to third-party websites or services. We are not responsible for the content, privacy, or security practices of those third parties.

We may update this Policy from time to time. When we do, we will update the "Last updated" date above. If changes are material, we may provide additional notice through the Services or by email.
